Terms and conditions of advertising on EscapeLets.

  1. Accuracy of advertisements:
    EscapeLets.com cannot accept any legal responsibility for the accuracy of any information entered by owners within the EscapeLets.com website. All text information (copy) entered in property advertisements is the sole responsibility of the property owner. EscapeLets.com do not verify the accuracy of property advertisements and advise holidaymakers to investigate the authenticity of supplied copy and details thereof. EscapeLets.com are therefore not liable for property advertisement inaccuracies or misleading content provided by property owners on the website.
  2. Use of the site:
    It is a condition of this site's use that users agree that the site must not be used for any unlawful or prohibited purpose, outlined in these terms and conditions or by other applicable laws and regulations. In using this site you indemnify EscapeLets.com from any loss, damage or costs in connection with any breach of these conditions or any legal obligation by you, your use or conduct using this site.
  3. Minimum requirements:
    Property advertisements must contain at least one image of the property itself, and have a clear, non-misleading, accurate description of the property. Although not mandatory, listings will attract more visitors if they list available facilities, display rental rates and have the location coordinates plotted correctly. With minimum information provided a property advertisement can be requested for validation and be activated for display.
  4. Advertisement duration:
    All property advertisements will remain visible, free of charge, in user searches provided that the following conditions are met:
    (a) The owner logs into the account and maintains the accuracy of the property listing and keeps the rental rates up do date, at least once a year.
    (b) The property displays the minimum required information (see section 3).
    (c) The EscapeLets.com terms and conditions are abided to in full.
    EscapeLets.com reserves the right to remove any non conforming property advertisement without notice to the owner.
  5. Copyright:
    Property owners advertising at EscapeLets.com warrant that they own the copyright to all supplied photographic and textual material used within their property advertisements, or have obtained consent for the lawful use of any material by the legal copyright owner. The advertiser grants EscapeLets.com consent to use, part or as a whole, any copy or photographic material used within advertisements, royalty free, for promotional purposes including advertisements and public relations purposes. EscapeLets.com cannot be held responsible for any infringement of copyright laws resulting from material supplied by the advertisers.
  6. Photographic material:
    Although EscapeLets.com provide a digital image upload facility, we recognise some advertisers will not have access to digital image editing tools. Escape lets can upload photographs that are sent via post and will make every effort to safeguard all photographic materials supplied, and return them if required (if a stamped addressed envelope is provided), but cannot be held responsible for any loss or damage, however sustained. Every effort will be made to reproduce faithfully all photographs submitted, by the website or by post. EscapeLets.com cannot be held responsible for any loss or damage or otherwise resulted from manual or automatic reformatting / resizing, image cropping, blemishes or omission.
  7. Multiple properties:
    All property advertisements submitted to EscapeLets.com by advertisers are for single property units. If an owner wishes to advertise more than one property unit, an additional advertisement must be created, unless prior agreement has been made with EscapeLets.com. All advertisements must be about a property and not a property company. EscapeLets.com reserves the right to amend any advertisement not adhering to this condition. If an owner lists more than 10 properties, ALL listings will have any Website back links automatically disabled. Our policy allows commercial letting agents to list their properties, but not to spam the EscapeLets listings with back links. Listings will always have an email contact form, where your telephone number will be displayed if required.
  8. Multiple owner accounts:
    An owner (or agent) is entitled to a single EscapeLets owner account unless prior agreement has been made with EscapeLets.com. If an owner is found to have more than one owner account without agreement, will risk having their listings moved to a single owner account. EscapeLets.com reserves the right to remove any owner account and associated listings if this condition is broken. This condition is in place to help prevent commercial agents from spamming the site by exploiting our free listing policy with external website links (link backs). Please see conditions 7 & 15 regarding multiple properties and external hyperlinks.
  9. Changing properties:
    Existing properties must not be substituted with another by way of changes to the copy, photographs or other details without prior consent from EscapeLets.com are given to the advertiser. EscapeLets.com reserves the right to remove offending advertisements without notice or refund.
  10. Website layout:
    EscapeLets.com reserve the right to determine the final layout of property advertisements including the right to edit copy, amend supplied photographs or other submitted details. EscapeLets.com cannot be held responsible for any loss, or damage, due to the layout, design or positioning, changes to photographs or the copy of advertisements submitted by owners.
  11. Liability:
    While EscapeLets.com aims to provide a first class service, it makes no warranty that the site operation will be uninterrupted or error free. EscapeLets.com shall not become liable to advertisers for any special, consequential, incidental or indirect damages, including loss of profits, however caused.
  12. Privacy:
    All information held about advertisers and site users will be kept confidential by EscapeLets.com. All reasonable steps are taken by EscapeLets.com to ensure information is secured securely and accurately. Personal information will never be provided to third parties for marketing or promotional use. EsacapeLets.com are registered with the UK's Data Protection Act (Act of Parliament 1998) and as such will abide with all current and future laws defined under this legislation.
  13. Advertisement termination:
    If substantiated complaints about a specific property advertisement are received by EscapeLets.com, regarding misleading details about a property, its location, facilities or other details, EscapeLets.com reserves the right to remove the advertisement, without notice or refund. If an owner enters inappropriate material into their advertisement or misuses the on-line systems, EscapeLets.com reserves the right to remove the offending material, or remove the advertisement, without notice or refund for persistent misuse.
  14. Contact details:
    EscapeLets.com maintain a high level of service to holidaymakers using this site, and therefore request that all advertisers to respond to enquiries by telephone or email within 7 days. Advertisers should provide an answer phone message or email 'out of office' response message if they are unavailable. If these options are not available, we ask that you disable (hide) you advertisement via your manage property page. EscapeLets.com reserves the right to disable advertisements for owners unreachable for more than 7 days. Owners can re-enable advertisements via the manage property page.
  15. External hyperlinks:
    EscapeLets.com allows a single hyperlink within property advertisement to an external website (link back), but that link can only display a page about the same property and not to a 3rd party property lettings site. EscapLets.com reserve the right to remove any hyperlinks or email addresses in the advertisement body which link to un-associated sites or content, or act against the company or its advertisers. If an advertiser adds (or re-adds after removal) hyperlinks or email addresses to advertisements, EscapeLets.com reserve the right to terminate the advertisement without refund. If an owner has more than 10 properties are listed, ALL listings will have hyperlinks to external websites disabled.
  16. Changes to advertising rates and conditions:
    EscapeLets.com reserves the right to amend featured or spotlight advertising rates and conditions without notice. Any modifications to rates or conditions will become applicable upon posting at the EscapeLets.com website for new advertisers and upon advertising renewals.
